New Immigration Registration Rule for Foreign Nationals (US)

As of April 11, 2025, a new online registration system by the U.S. Department of Homeland Security (DHS) has come into effect, requiring certain foreign nationals staying in the United States for more than 30 days to register. This update is based on the Alien Registration Act of 1940, which mandates that all foreign nationals residing in the U.S. for over 30 days must be registered and fingerprinted. The new system modernizes this requirement through an online process.

Those required to register include individuals who entered the U.S. without inspection (EWI), visa-exempt Canadians who were not issued a Form I-94 and plan to stay for over 30 days, and foreign nationals turning 14 years old who have already been in the U.S. for 30 days or more. On the other hand, individuals who already possess valid registration-related documents—such as visas, green cards, I-94 admission records, Employment Authorization Documents (EAD), or a Notice to Appear—are considered already registered and are not required to re-register. Additionally, diplomats, individuals staying less than 30 days, and certain Native Americans born in Canada are exempt from this requirement.

Those required to register must create an account on the USCIS website, submit biometric information via Form G-325R, undergo a background check, and download a “Proof of Alien Registration” document, which must be printed and carried at all times. Even individuals not required to register must carry valid proof of registration, such as an I-94, green card, or EAD.

Moreover, all foreign nationals—regardless of whether they must register—are legally obligated to notify USCIS of any change in residential address within 10 days by submitting Form AR-11. Failure to comply with these regulations may result in serious legal consequences, including fines up to $5,000, imprisonment, or even removal from the U.S.

This new DHS rule aims to streamline compliance with existing immigration laws but imposes strict obligations on specific groups. Individuals who fall under this requirement are urged to register promptly, carry proof of registration at all times, and seek legal advice if there is any uncertainty about their immigration status.
