Migrants’ Experiences of the UK Immigration System: Key Insights

Summary
The Migration Observatory's recent report on migrants' experiences with the UK immigration system highlights several key issues and potential solutions. It found that many migrants, particularly those with digital status or eVisas, faced difficulties when trying to prove their right to live and work in the UK. In some cases, the individuals checking their status did not accept the evidence provided, especially for those with digital documents. This problem could lead to migrants being denied access to employment, healthcare, and housing. With the UK immigration system moving towards full digitalization by January 2025, it is crucial that those responsible for checking immigration status are well-informed.
The report also highlighted the complexity of the immigration rules, which left many migrants uncertain about their rights and obligations in the UK. This lack of clarity has caused confusion, and there is a need for clearer guidance and support to make the system more accessible. Migrants with eVisas, in particular, reported more issues with proving their status compared to those with physical documents like Biometric Residence Permits, with some even encountering errors in their recorded status.
Another significant finding was the lack of awareness among holders of pre-settled status regarding their rights, especially in relation to benefits and absences from the UK. This lack of understanding could lead to unintentional non-compliance, causing potential legal problems.
The report also stressed that the Home Office's plan to fully transition to a digital system by 2025 could worsen these issues unless there is adequate preparation for employers, landlords, and other organizations that check immigration status. To address these challenges, the report recommends improving awareness among migrants about their rights and conditions, through targeted information campaigns and accessible resources. It also calls for comprehensive training programs for stakeholders like employers and landlords, focusing on how to properly recognize and accept digital documentation to ensure compliance with immigration laws and avoid discrimination.
