Employers are given only three days to submit all I-9 forms and supporting documents during an audit, prompting panic among HR departments and legal teams. Even minor mistakes—like a missed checkbox—can lead to fines starting at $2,861 per violation. Companies are now proactively reviewing their records, often uncovering expired work authorization documents and being forced to terminate affected employees.
ICE's enforcement efforts, which ramped up during Trump’s previous term, are now broader in scope, expanding beyond small urban businesses. The rollback of Biden-era protections, such as Temporary Protected Status for nationals from unstable countries, has further complicated compliance for employers, as previously valid documents are suddenly invalidated.
The situation has become so burdensome and unpredictable that many in the HR field describe it as “I-9 hell.” Legal and compliance services are in high demand, and business leaders are struggling to navigate a regulatory environment that is more aggressive and far-reaching than in past administrations.
