Summary
This week, Smith Stone Walters reported key immigration updates from Canada, Denmark, Finland, New Zealand, and the United States.
In Canada, a new process allows eligible International Experience Canada (IEC) participants already in the country to receive their new work permits by mail, avoiding the need to exit and re-enter Canada. This is in response to the ban on “flagpoling” since December 2024. The new process is available until 1 December 2025, with specific eligibility and legal status requirements.
Denmark has amended its student residence permit rules. From 2 May 2025, students from third countries enrolled in non-state-approved higher education programs will no longer receive work permits, six-month job search periods, or the right to bring accompanying family members. Existing permits issued before this date remain unaffected.
In Finland, amendments to the Aliens Act took effect on 6 May 2025, tightening rules around illegal residence and removals. The changes include longer entry bans (up to 15 years), extended detention periods (up to 18 months), and a clearer definition of when residence becomes illegal. The aim is to improve security and enforcement efficiency, especially in cases of denied residence or asylum.
New Zealand will remove the requirement for certified translations for visitor visa supporting documents starting 26 May 2025, aligning its policy with Australia’s. Translations must still be done by qualified individuals, excluding applicants, their relatives, or advisors. Certified translations remain necessary for resident visa applications. Additionally, PEV (Pacific Engagement Visa) ballot winners from early 2025 are reminded to apply for their visas within the deadline.
In the United States, Romania's designation in the Visa Waiver Program has been rescinded as of 2 May 2025 following a security review. Romania may requalify in the future if it meets eligibility standards. Also, updated DS-160 form procedures require visa applicants to ensure their form data is complete and correctly matched with their appointment, or risk rescheduling.
Finally, Smith Stone Walters announced a partnership with Envoy Global to enhance their global immigration services and expand their client support capabilities.
